We point out to the fact that all prices are offered under reservation and depending from the price fluctuations at the world market according to product and country of origin that can vary daily on which the MII Oil Holding has no influence.

B.)

In this specific case the MII Oil Holding has the right to change the prices same day without prior notification. This applies also to customers that has in course a pending transaction or customers and supplies based on a long-term supply agreement with the MII Oil Holding.

The major prices of the goods shall be equal to the three-day quotations published by «Platt’s European Markets can» under the heading titles “average FOB MED-ITALY” and < Cargoes CIF NWE/basis ARA> effective on date before, date of Bill of lading and date after Bill of Lading proceeding the issuing date of CMR. CIM, B/L. Rates to be referred to the quotations as reported by Platt’s European Market can.
